Elder Care Mediation
Elder Care Mediation creates an avenue for family decision-making. It is private, confidential, and voluntary which lends itself to increased communication so the parties can resolve their differences. Mediators facilitate a focused discussion in which the family members are encouraged to express their concerns, opinions and interests. The mediator is a highly skilled, objective facilitator whose primary role is to help the family members to reach a resolution for their differences. It is a cooperative rather than an adversarial process that helps to repair or prevent strained family relationships.
Typical issues that are addressed in Elder Care Mediation are areas such as residential decisions, distribution of care giving responsibilities, safety and health concerns, wills and estates, the sale of the family home or who is designated the Power of Attorney. Many times various family members have different opinions regarding the proper solutions which can then give rise to conflict. Attempting to resolve these conflicts in the courtroom only increases the intensity of the conflict and results in strained relations that may endure a long time.
Mediation should not be saved as a "last resort" option which is only considered after all else has failed and the emotions are already intensified. The earlier that mediation can occur, the better the resulting outcome.
